Inheritance and succession

Organizing the information before making decisions

When a person dies, starting a procedure is not always the first or only step. It may first be necessary to determine whether there is a will, identify the potential heirs, establish which assets and liabilities form part of the estate and review whether any proceedings are already under way.

An orderly review helps distinguish the formal recognition of the heirs from the later administration or distribution of the assets. It can also identify real estate, tax or court matters that should be coordinated before a decision is made.

Through our Civil Law practice, we assist heirs and other interested parties in reviewing the available information, defining a course of action and carrying out the agreed steps.

Chilean procedure

Posesión efectiva with or without a will

In Chile, the procedure used to formally recognize the heirs is known as posesión efectiva. Whether the person left a will determines where the process begins.

If there is no will

The application is submitted to Chile's Civil Registry and Identification Service. A person who qualifies as an heir may apply, identifying the other heirs and providing or declaring the information required for the inventory. A lawyer is not mandatory for this administrative application.

This does not mean that every intestate estate is straightforward. A legal review may become particularly relevant when the estate includes real estate, companies, assigned inheritance rights, omitted assets, debts or disagreements that must be addressed after the posesión efectiva has been granted.

If there is a will

The application for posesión efectiva must be submitted to the competent civil court and requires representation by a lawyer. The review covers the will, the identification of the heirs and known assets, and any documents required according to the composition of the estate.

Partition and allocation

When heirs need to divide the estate

After the posesión efectiva has been granted, the assets may remain jointly held by the heirs. Dividing the estate requires a review of the assets and liabilities involved, each party's rights and whether there is agreement on how the assets should be allocated.

When all interested parties agree, it may be possible to arrange a consensual partition, subject to the formalities and authorizations required in the particular case. If no agreement can be reached, it may be necessary to seek the appointment of a partition judge and proceed through the corresponding process.

Each alternative can have financial and legal consequences that should be considered before signing an assignment, allocation or partition agreement. When an estate includes real estate or raises tax matters, we coordinate the review with the relevant practice areas, including our Tax Law practice.

Frequently asked questions

Questions about inheritance in Chile

Do I need a lawyer for posesión efectiva in Chile?

It depends. If the person died without a will, the application is made through the Civil Registry and does not require a lawyer. If there is a will, the application is made before a civil court and requires legal representation. In either situation, advice may be useful when the background is complex, the heirs disagree or further steps need to be coordinated.

What happens if the person died without a will?

The estate is governed by the applicable rules of intestate succession, and the application for posesión efectiva is submitted to the Civil Registry. The heirs must be identified and the known assets of the person who died must be declared. The circumstances should be reviewed when family or financial relationships are not sufficiently documented.

How is an inheritance handled when there is a will?

The application for posesión efectiva is submitted to the competent civil court with legal representation. The will, information concerning the person who died and the heirs, and the documents relating to the estate's assets must be reviewed.

What happens if the heirs do not agree?

The first step is to identify the nature of the disagreement. It may concern the assets, their valuation, their administration or the way in which they should be divided. If an agreement cannot be reached, a partition procedure may be required. The strategy depends on the available information and the rights involved.

Does posesión efectiva automatically distribute each asset?

Not necessarily. Posesión efectiva identifies the recognized heirs and allows the estate to move forward. Allocating specific assets may require a partition agreement, registrations or other subsequent steps.

Which documents should I gather?

As a starting point, it is usually useful to have the death certificate, documents showing family relationships, the will if one exists and a preliminary inventory of assets and liabilities. If the estate includes real estate, vehicles, companies or proceedings already under way, the related title documents, registrations and decisions should also be identified.

Can an inheritance involve tax procedures in Chile?

Yes. Depending on the assets, allocations and circumstances of the estate, it may be necessary to determine whether inheritance tax is payable or an exemption applies and to obtain the corresponding certificates. Tax treatment must be reviewed against the facts of the particular estate.

How long does the process take and how are fees determined?

There is no single timeframe or fee for every estate. Both depend on whether there is a will, the documentation available, the assets involved, the degree of agreement between the interested parties and the steps required. After the initial assessment, we provide a proposal setting out the scope of the service and the applicable fees.

If you need to complete a posesión efectiva, review a will or determine how to approach the partition of an estate in Chile, you can send us a general description of the matter. Submitting a contact request does not mean that Lara, Andrade y Cía. has accepted the engagement and does not, by itself, create a lawyer-client relationship.
